Legal Terms and Agreement

By accessing and using the website https://www.mexicolivingtours.com/ (the "Site") and booking tours or services through Mexico Living Tours (hereinafter "we," "us," or "our"), you (the "Customer" or "you") agree to be bound by the following legal terms and agreement (the "Agreement"). Please read these terms carefully before using our Site or booking our services.

1. Booking and Contract Formation

  • All bookings are subject to availability and confirmation by us.

  • A contract between you and Mexico Living Tours is formed when we issue a booking confirmation (e.g., via email) after we have received your payment or deposit, as specified at the time of booking.

  • The person making the booking warrants that they have the authority to accept and do accept these terms and conditions on behalf of all persons named in the booking.

 

2. Payment Terms

  • The total price of the tour or service, including any applicable taxes and fees, will be displayed at the time of booking.

  • We accept various forms of payment as indicated on our Site.

  • A deposit may be required to secure your booking, with the remaining balance due by the date specified in your booking confirmation.

  • Failure to pay the balance by the due date may result in the cancellation of your booking and forfeiture of any deposit paid.  

 

3. Cancellations and Refunds

  • Our cancellation policy varies depending on the specific tour or service and the timing of the cancellation. The applicable cancellation policy will be communicated to you at the time of booking.

  • Cancellations must be made in writing (e.g., via email) to us.

  • Refunds, if applicable according to the cancellation policy, will be processed within a reasonable timeframe.

  • We reserve the right to cancel a tour or service due to unforeseen circumstances (e.g., safety concerns, weather conditions, insufficient participants). In such cases, we will offer you a full refund or the option to reschedule to an alternative date or tour of comparable value, subject to availability. We shall not be liable for any consequential losses or expenses incurred by you as a result of such cancellation.

 

4. Changes to Bookings

  • Requests for changes to your booking (e.g., date changes, changes in the number of participants) are subject to availability and may incur additional charges as determined by us and/or our suppliers.

  • We will use reasonable efforts to accommodate your requests, but we cannot guarantee that changes can be made.

 

5. Customer Responsibilities

  • You are responsible for ensuring that all information you provide to us in connection with your booking is accurate and complete.

  • You are responsible for possessing valid travel documents, including passports, visas, and any required health certificates, that meet the requirements of Mexican law and any other applicable jurisdictions.

  • You are responsible for adhering to the instructions and guidelines provided by our guides and representatives during tours and activities, including those related to safety and conduct.

  • You are responsible for being at the designated meeting point at the scheduled time. We are not responsible for any losses or expenses incurred due to your late arrival.

  • You are responsible for your personal belongings during tours and activities. We are not liable for any loss or damage to your personal items.

  • You agree to conduct yourself in a respectful and appropriate manner towards our staff, other participants, and members of the public. We reserve the right to exclude you from a tour or activity if your behavior is deemed disruptive or offensive, without any right to a refund.

 

6. Our Responsibilities and Limitations of Liability

  • We will use reasonable skill and care in providing our tours and services.

  • We are not liable for any personal injury, death, loss, damage, accident, delay, or inconvenience that may occur due to:

    • Your own negligence or the negligence of any member of your party.

    • The actions or omissions of third parties not directly employed by us (e.g., hotels, transportation providers). In such cases, our liability will be limited to our selection and supervision of these third parties to a reasonable standard.

    • Unforeseeable and unavoidable events beyond our control (force majeure), such as natural disasters, adverse weather conditions, political unrest, or other events that could not have been reasonably anticipated or avoided.

    • Circumstances attributable to a lack of valid travel documents.

  • Our maximum liability to you for any claim arising out of your booking or the provision of our services is limited to the total amount paid by you to us for the specific tour or service in question.

  • Nothing in this Agreement shall exclude or limit our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Mexican law.

7. Intellectual Property

  • All content on our Site, including text, images, logos, and trademarks, is the property of Mexico Living Tours or its licensors and is protected by intellectual property laws.

  • You may not use, reproduce, or distribute any content from our Site without our prior written consent.

8. Links to Third-Party Websites

  • Our Site may contain links to third-party websites for your convenience. We do not endorse and are not responsible for the content, privacy policies, or practices of these websites. You access these websites at your own risk.

9. Governing Law and Jurisdiction

  • This Agreement shall be governed by and construed in accordance with the laws of Mexico, specifically the laws of the State of Quintana Roo.  

  •  

  • Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Playa del Carmen, Quintana Roo, Mexico.

10. Entire Agreement

  • This Agreement constitutes the entire agreement between you and Mexico Living Tours with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

11. Severability

  • If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12. Amendments

  • We reserve the right to modify or amend this Agreement at any time by posting the updated terms on our Site. Your continued use of our Site or booking of our services after the posting of changes constitutes your acceptance of the revised Agreement.
